I am reminded of the situation of Brock Turner, who was a Stanford student and convicted of having intercourse with an unconscious woman. Apparently, this is a crime in CA. It turns out that Turner, and the woman, had been at a succession of fraternity parties, both drinking a lot, and flirting with each other. They decided to leave, to go back to the dorm room of one of them, to have sex. But they fell onto each other on the way. Someone noticed this activity -- intimacy in the open air -- and called police. It turned out the woman had passed out from her intoxication, and during the hearing, she said she would never have behaved in such a way had she not been intoxicated. Turner had no history of such behavior, and what wasn't taken into account was the likelihood that he would never have behaved that way had he not been intoxicated, either.

I will tell you that I have been a psychiatrist for over 48 years, and I learned an extremely long time ago that what people say, and how they behave, when they're intoxicated can be dramatically different from what they say when they sober up. I've spent enough time in enough emergency rooms, with decompensated intoxicated people, to know that very well. There is always an urge to come to conclusions, including making diagnoses, when people are intoxicated with one thing or another, and the people are nothing like that when they're no longer intoxicated. But they commonly wind up with two diagnoses: intoxication/substance abuse, and whatever is the other diagnosis (depression, psychosis, mania, or anything else). The second diagnosis is very commonly wrong.
